Arbitration in the Automotive Industry
Is there a need for an Industry-Specific Dispute Resolution Forum?
This article was initially published in the second issue of the 2018 quaterly e-journal of the International Chamber of Commerce (ICC). The ICC has agreed to Simmons & Simmons making it available on elexica.
This article presents the features of the automotive sector through a study of arbitral awards, including unpublished ICC Awards, as well as a categorisation and discussion of the main disputes/actors involved at different levels of the automotive production and supply chain. It finally addresses the question as to whether specialized arbitration centres would be of added value for dispute resolution in the automotive industry.
