German Ministry of Justice reveals plan to continue in UPC project

German Ministry of Justice reviews options to achieve the necessary majority and continue Germany’s involvement in UPC project.

Since the 20 March 2020 German Constitutional Court’s decision that the Act approving the UPC Agreement was void for not meeting the necessary Bundestag (two thirds) majority, the German Ministry of Justice has indicated that it wishes to continue with the UPC project. We understand that the Ministry of Justice is reviewing the Constitutional Court’s judgment and considering how best to proceed to achieve the necessary majority. This should be completed in the current term i.e. by Summer 2021. Once this has been done, Germany should be free to ratify the Provisional Application Protocol. This would set the clock ticking for ratification of the UPC Agreement and the UPC opening about 12 months later.
