Josh Farquharson is a Supervising Associate in our Disputes & Investigations team. Josh advises across complex commercial litigation, arbitration and regulatory investigations.
With a particular focus on contentious matters for clients in the TMT and financial services sectors, he regularly advises leading telcos, fintechs, banks, financial institutions and manufacturers operating in the region, UK and globally. He has a unique blend of regional and international experience, gained through our Dubai and UK offices respectively.
Josh has previously been seconded to bp's Litigation team and Nomura's EMEA Legal team.
His recent experience includes:
Securing successful settlements for fintechs in both DIFC and ADGM Court proceedings;
Enforcing a DIFC Judgment in a matter involving alleged misrepresentation in the context of a loan and guarantee;
Acting for financial institutions subject to third-party disclosure orders before the DIFC Courts;
Acting for a UAE-based technology business as claimant in an LCIA arbitration;
Acting for a financial institution in a DFSA investigation;
Advising on product liability regulations in the UAE and wider Middle East;
Conducting investigations for multinational conglomerates based in the UAE; and
Acting for BT in the successful defence of a $1.3bn class action before the English Competition Appeal Tribunal and the Court of Appeal (Le Patourel v BT [2024] CAT 76; [2025] EWCA Civ 1061) - the first of its kind to reach trial, involving complex issues of economics, competition law and novel considerations relating to the use of AI in disclosure.
