AIFMD 2.0 – the Council of the EU adopts the agreed amendments

Following the European Parliament’s endorsement, the Council of the EU has approved the amendments to the AIFMD agreed in October 2023.

As we reported earlier this month, on 7 February 2024, a plenary session of the European Parliament approved the amendments to the AIFMD which it had agreed with the Council of the EU following last year’s trilgoue negotiations.

This was one of the two key procedural steps that needed to be taken for the AIFMD to be amended.

The Council of the EU has now announced that it, too, has endorsed the deal and formally adopted the amendments.

Next steps?

What now remains is for the text to be published in the Official Journal. It will formally enter into force on the twentieth day following publication.

EU Member States will have 24 months from entry into force to transpose the changes into their national law.

The new provisions will then become applicable in (most likely) March or April 2026, depending on when the text is published.
