The duty to mitigate is often misunderstood. Parties are expected to act reasonably to reduce loss, but they are not required to sacrifice their own commercial interests to protect the other side from the consequences of a breach.

In this 20-minute online discussion, we will examine the line between reasonable mitigation and justifiable inactivity. Using practical examples from delay and disruption claims in the Middle East, they will discuss what project teams can reasonably be expected to do when faced with delay, and where mitigation ends and acceleration begins.

The webinar will focus on practical issues arising on live projects rather than legal theory.
